Nominees to Kenya's top two legal jobs are proving extremely controversial - because of their pro-gay history. Kenne Mwikya looks at the context, and the strange focus on the fact that Kenya's proposed next Chief Justice has an earring.

The nomination of Dr. Willy Mutunga and Nancy Baraza to the post of Kenyan Chief Justice and Deputy Chief Justice has brought with it a unique chance for Kenyans to rethink stereotypes and the policing of certain bodies, values and ideals differently. The Judicial Service Commission, the body mandated to vet candidates who had applied for both positions made it clear that one of the main reasons it chose the said candidates is that they were known reformers, were outsiders from the judicial system (meaning they are lawyers rather than judges) and they would likely bring fresh ideas and extensive knowledge of the law into the judiciary.

The JSC Chairperson said of the nomination and nominees:

“We have picked people who will reform the justice system and our judiciary. ... We wanted someone who can provide leadership to the courts and has shown passion and zeal to help Kenyans realise the dream in the new constitution, especially its values of equality, justice, fundamental rights and freedoms and a commitment to the rule of law”

Though their nominations by the JSC and the fact that President Mwai Kibaki and Prime Minister Raila Odinga have agreed with these nominations paving way for their vetting in parliament it seems that their passing through parliament will be a bit tougher than expected. A lawyer in Nairobi has already petitioned the High Court to reject the nominations on various grounds including the fact that both candidates that “promoted homosexuality” and the selection of one nominee per office “tied the hands of the President, the Prime Minister and Parliament in consultations and debate”. A member of the Ugandan parliament and an American pastor are top 2011 candidates for the Homophobia Hall of Shame, Human Rights Watch said today. Human Rights Watch made the announcement in advance of the International Day Against Homophobia and Transphobia on May 17.

David Bahati, the Ugandan parliament member, is the author of a draconian Anti-Homosexuality Bill discussed in parliament in recent days. Scott Lively, the pastor, has urged governments around the globe, including Uganda, to deny basic human rights to lesbian, gay, bisexual and transgender people.

"Both Bahati and Lively are promoting hatred and putting the lives and security of LGBT people at serious risk," said Graeme Reid, director of Lesbian, Gay, Bisexual, and Transgender Rights (LGBT) Program at Human Rights Watch. McGreevey Pursues Dream to Join Episcopal Clergy: James E. McGreevey, who resigned as New Jersey's governor in 2004, now works for Integrity House in Newark helping people deal with drug problems.

Former Governor James McGreevey hopes to be accepted as a candidate for priesthood in the Episcopal Church

¨In one sense, James E. McGreevey, the former New Jersey governor, is again campaigning for office: He hopes to be accepted as a candidate for the priesthood in the Episcopal Church, which has begun ordaining openly gay men and women. He has already earned a divinity degree, but his application to proceed with the next step, to become a postulant, was rejected last month. He says he plans to keep trying, and his current work is a kind of test ground of his commitment.

Mr. McGreevey is the newest recovery specialist at a residential drug treatment center in Newark called Integrity House, and one recent morning he zigzagged buoyantly down the street, like the perennial political office-seeker he used to be. ANNUAL ¨RALLYING EVENT¨ MAY 17th: The International Day Against Homophobia (IDAHO)

The International Day against Homophobia and Transphobia (IDAHO), held on May 17 every year, is a rallying event offering an opportunity for people to get together and reach out to one another. It aims to coordinate international events to call respect for lesbians and gays worldwide.

Unlike the Pride Days , which are meant to emphasize pride in one' sexuality and refusal to be ashamed of it, IDAHO is held to highlight that in reality it is homophobia that is shameful and must be deconstructed in its social logic and fought against openly.

May 17 was chosen as the day of the event because homosexuality was removed from the International Classifications of Diseases of the World Health Organization (WHO) on May 17, 1990.

Homophobia is described as ‘hatred of homosexuality” “hatred of homosexuals” “fear of gays and lesbians” “a desire or attempt to discriminate against homosexual’’ and is fuelled by a multiple of reasons including inability or unwillingness to change the hatred taught during childhood, fear of people who are different, promotion of homophobia by religious groups, a natural feeling of repulsion at the thought of same-sex activity. Realizing that homosexual behavior is unnatural for them, some people generalize this feeling into the belief that homosexuality is wrong for everyone; actual homosexual feelings that a person cannot acknowledge or handle, low self esteem leading to a need to hate other groups, are also cited as fueling factors of homophobia.
Usually, homophobia manifests itself in many forms: Violence, insults, physical assaults, evictions, denial of services or rights and privileges, stigma, distancing, and in extreme form, death. There are even reported cases of desecrations of bodies of suspected gays by exhumation and further humiliation. please read it all HERE

Absolutely, Positively, The Last Time I Will Write About the Anglican Covenant (Until Next time)

The REAL Anglican Covenant: "Jesus replied: “‘Love the Lord your God with all your heart and with all your soul and with all your mind.’[a] 38 This is the first and greatest commandment. 39 And the second is like it: ‘Love your neighbor as yourself.’[b] 40 All the Law and the Prophets hang on these two commandments.” Matthew 22:37-40. This passage also appears in Mark and Luke in slightly different language but the same covenant.

Once again, many of our most learned members of the Episcopal Church continue to grind on the Anglican Communion Covenant. Is this not a waste of time, talent, and treasure? Could these folks better spend their time figuring out "how many angels can dance on the head of a pin"?

are the Episcopal Church of the United States of America and by now, it is clear to the international community that the covenant we follow is summed up in the two great commandments. Nothing is going to change that. Nothing is going to somehow magically change the voices of those who would punish and kill those members of our community that wish to "have life abundantly". We work on our relationship with God and our neighbor virtually everyday and nothing he Global south or the folks that like to confess everything but their sins against their fellow man/woman can say or do to stop us.

So I ask, why all the "deep and serious" writing about "The Anglican Covenant"? If it is because the Archbishop of Canterbury "asked" us to I need to say why? The last time that happened in any serious vein I think we formed and Army and beat the snot out of Cornwallis. Do we think that somehow the "Anglican Communion" in all it's glory outweighs the message in Matthew, Mark, and Luke? I certainly hope not. Does it make any sense at all to "review and discuss and vote" on a covenant that will set up the primates so that they can then be the new and improved Matthew, Mark, Luke and John? For my money, I have heard nothing from a single one of them, including the Archduke of ACNA and the Global South that even closely approximates the message Jesus gave us. Why then would we allow this bigoted, mean-spirited, evil group of men "run the Anglican Communion" let alone tell us how and what to think.

This covenant deserves no time, no energy, no more paper and ink and no more thought. We need to use our precious resources to serve the hungry, needy, naked, and imprisoned. We need to be about "our Father's business." HERE

There has also been impressive work between the Ugandan community and embassies in Uganda on a level that has been challenging in the past and in other parts of the world. Activists have had to immerse themselves in the workings of the parliamentary process and become familiar with legislative procedure. Activists have become intimately familiar with the inner working of media houses, the process of getting stories accepted or rejected. The bill was tabled on October 14, 2009 after American religious fundamentalists met with MP David Bahati. Four months later the Human Rights and Peace Center at Makerere University organised The Human Rights and Sexual Orientation forum where Val Kalende declared, "This day marks the beginning of the end from exile of the gay and lesbian people."

¨Fellow Human rights activists, distinguished guests and all Ugandans. I am proud to stand before you as a lesbian today. With hearts full of love and the abiding faith in justice, we have come to this place to speak to Uganda. We have come to speak the truth of our lives and silence the liars. Warren Throckmorton: ¨American Psychiatric Association issues statement against Uganda’s Anti-Homosexuality Bill¨

Whereas: The Hon. David Bahati, a member of the Ugandan Parliament, has introduced an Anti-Homosexuality Bill in the Ugandan Parliament calling for:

1.  Seven years of imprisonment for anyone who attempts to engage in homosexual contact
2.  Life imprisonment for anyone who engages in sexual penetration of a member of the same gender;
3.  Death for “aggravated homosexuality” which includes repeated offenses of homosexuality or engaging in a homosexual act while HIV-positive.
4.  Imprisonment of up to three years for failing to report violations of the statute within 24 hours of awareness of the offense

¨Earlier this evening, the American Psychiatric Association formally condemned the Anti-Homosexuality Bill in Uganda. Although the bill appears to be finished for this Parliament, it may be back during the next one. The APA wanted to make clear to mental health professionals in Uganda that the proposed bill was counter to professional guidance.  HERE is the action paper¨

Evangelizing Murder in Uganda? Anglican David Kato, RIP

¨...Ugandan LGBT activist Anglican David Kato was bludgeoned to death in his home just weeks after his photo was emblazoned on the cover of a local newspaper with the accompanying headline "HANG THEM!" The newspaper articles and Kato's murder came after months of international outrage over Uganda's proposed and still-pending "kill gays" bill, legislation that orders the death penalty for homosexuals in some cases and life imprisonment in others. ¨David Kato tirelessly devoted himself to improving the lives of others. As an advocate for the group Sexual Minorities Uganda, he worked to defend the rights of lesbian, gay, bisexual, and transgender individuals. His efforts resulted in groundbreaking recognition for Uganda’s LGBT community, including the Uganda Human Rights Commission’s October 2010 statement on the unconstitutionality of Uganda’s draft “anti-homosexuality bill” and the Ugandan High Court’s January 3 ruling safeguarding all Ugandans’ right to privacy and the preservation of human dignity.
