CONCERNED ABOUT RETALIATION: Ugandan court invalidates anti-gay law, ¨Null and Void¨

¨The anti-gay measure was enacted on Feb. 24 by Ugandan President Yoweri Museveni, who said he wanted to deter Western groups from promoting homosexuality among African children¨

KAMPALA, Uganda — A Ugandan court on Friday invalidated an anti-gay bill signed into law earlier this year, saying the measure is illegal because it was passed during a parliamentary session that lacked a quorum.

The panel of five judges on the East African country’s Constitutional Court said the speaker of parliament acted illegally when she allowed a vote on the measure despite at least three objections – including from the country’s prime minister – over a lack of a quorum when the bill was passed on Dec. 20.

“The speaker was obliged to ensure that there was a quorum,” the court said in its ruling. “We come to the conclusion that she acted illegally.”

The ruling was made before a courtroom packed with Ugandans opposing or supporting the measure. Activists erupted in loud cheers after the court ruled the law is now “null and void.”

The anti-gay measure provided for jail terms of up to life for those convicted of engaging in gay sex. It also allowed lengthy jail terms for those convicted of the offenses of “attempted homosexuality” as well as “promotion of homosexuality.”

Frank Mugisha, a Ugandan gay leader, said the ruling Friday was a “step forward” for gay rights even though he was concerned about possible retaliation.

Ugandan lawyer Ladislaus Rwakafuuzi, an attorney for the activists, said the ruling “upholds the rule of law and constitutionalism in Uganda.”

Anti homosexuality bill should not be discussed not needed redundant and unnecessary says Ugandan Government...The government has spoken despite all efforts by Bahati to pass the bill , it will not be brought up for discussion in the 8th parliament.

Last week MP David Bahati and Stephen Tashobya were interviewed about pursuing the Bill in the 8th Parliament. A series of Wikileaks from early in 2010 indicate that President Museveni is interested in seeing the bill go away.

Gobierno ugandés descarta Proyecto de Ley que criminalizaba la homosexualidad

¨El Gobierno de Uganda descartó hoy un Proyecto de Ley que pretendía endurecer las penas contra la población homosexual.

El ministro de Información ugandés, Kabakumba Masiko, dijo hoy a los periodistas que un subcomité de Gobierno concluyó, en un informe, que no había motivo para adoptar otra Ley contra una práctica ya penada por las leyes de Uganda.

"El informe que nos llegó ayer apuntaba que había partes del proyecto de Ley que ya están cubiertas con otras normas", indicó Masiko.

El iniciador de la propuesta, David Bahati, diputado del partido gobernante, el Movimiento Nacional de Resistencia (NRM), insistió en que el texto debería pasar a un comité parlamentario que decidiera su futuro.

"Creo que el Ejecutivo es consciente de que el 95 por ciento de los ugandeses no toleran la homosexualidad", declaró Bahati.

El proyecto de Ley fue iniciado en 2009 y pretendía incrementar las penas contra los homosexuales con arrestos prolongados o incluso con la muerte en algunos supuestos, como cuando el imputado fuese seropositivo.

Este proyecto fue duramente criticado por los grupos defensores de los Derechos Humanos y por varios líderes mundiales.
